South Africa Strengthens Nuclear Safety with Landmark Regulatory Amendment

In a decisive move to enhance nuclear safety and align with global standards, President Cyril Ramaphosa has signed the National Nuclear Regulator Amendment Bill into law.

This milestone legislation updates the 1999 Act, introducing robust measures to protect South Africans from nuclear risks.

The new law empowers the National Nuclear Regulator (NNR) to oversee nuclear safety across various sectors, including the decontamination of defence facilities and the regulation of airline crew exposure to cosmic radiation.

By adopting best practices from the International Atomic Energy Agency (IAEA), the Amendment Bill positions South Africa as a leader in nuclear safety compliance.

Key highlights include:

  • Enhanced Defence Facility Safety: Old military equipment and sites exposed to nuclear materials must now be decontaminated and certified safe before civilian use.
  • Airline Crew Protection: The law mandates regulatory oversight of occupational exposure to cosmic radiation for aircrew flying below 49,000 feet.
  • Expanded Oversight Powers: The NNR gains broader authority over nuclear materials and activities, ensuring stringent safety protocols.
  • Global Alignment: The legislation aligns South Africa’s nuclear safety framework with international conventions and IAEA guidelines.

“This alignment is critical,” stated the Presidency, “as South Africa is a founding member of the IAEA and a signatory to conventions governing nuclear safety.”

The Amendment Bill introduces new definitions, updates outdated ones, and removes obsolete clauses to reflect evolving international best practices.

It also excludes the Defence Act of 2002 from applying to foreign naval vessels, addressing disclosure challenges for visiting foreign forces.

Minister of Energy Gwede Mantashe lauded the signing of the Bill, stating, This law reflects our commitment to ensuring that the use of nuclear materials benefits our people while safeguarding their health and the environment.”

Upholding safety standards, the legislation strengthens the control and management of the NNR’s operations, including the board’s term of office and the establishment of specialized committees.
